Representative Matters

Securities and Investment Fraud Litigation

  • Successfully represented a client in a business investment scam. The client/investor received 100% of their funds back.
  • Successfully represented client in FINRA securities fraud arbitration against a national broker dealer and its registered representative winning an award for compensatory damages and punitive damages.
  • Successfully represented client in private arbitration against a Registered Investment Advisor and its investment advisor representative by proving breach of fiduciary duty, professional negligence and negligent misrepresentations.
  • Successfully represented public customers against a national broker-dealer in securities fraud case in FINRA arbitration where claims for negligence, negligent supervision, suitability, lack of due diligence, selling away, breaches of fiduciary duty and other claims were also alleged. The public customer clients received a recovery of in the seven figures.
  • Successfully obtained a unanimous defense verdict in a securities fraud lawsuit filed against husband and wife business owners.
  • Representation of numerous public customer clients against broker-dealers and Registered Investment Advisors resulting in substantial settlements.
  • Representation of broker-dealers and registered representatives in FINRA arbitrations.
  • Ponzi scheme litigation.

Construction Law and Litigation

  • Represented some of Arizona’s largest home builders in all forms of construction litigation and administrative proceedings before the Arizona Registrar of Contractors.
  • Successful representation of contractors and subcontractors in Mechanic’s Lien lawsuits.
  • Represented many individual homeowners against general contractors and subcontractors in connection with construction defects.
  • Representation of contractors and homeowners regarding the termination of construction contracts.
  • Representation of subcontractors in claims brought by project owners or general contractors.
  • Successful representation of clients who terminated their general contractor for cause and were then sued for breach of contract and lost profits. 

Business Litigation

  • Successful trial verdict in a complex breach of contract case against business owners.
  • Successful representation of legal professionals in “business divorce” disputes.
  • Prosecution and defense of claims alleging all forms of business torts, breaches of contract and breaches of fiduciary duty.
  • Successful representation of businesses in bringing or defending against trade secret and unfair competition claims.
