Our services on behalf of
community associations include CC&R enforcement, collections, litigation,
administrative proceedings and advising association boards on a variety of
governance issues.
Sacks Tierney attorneys
are accessible and responsive in representing homeowners associations (HOAs) and
condominium owners associations in:

actions against homeowners/members,

legal
disputes involving outside service providers and vendors, and

administrative proceedings, before the Arizona
Attorney General’s Office and other state and local government agencies, on
a variety of matters, including discrimination claims.
Our representation of
community associations against homeowners/members is typically related to:

enforcement of the association’s Declaration of Covenants, Conditions &
Restrictions (CC&Rs) and other deed restrictions and governing documents,
and
-
collection of unpaid assessments and other charges due from property owners.
In addition, we advise
community associations and their managers concerning the interpretation of their
CC&Rs and other governing community documents and applicable law and, when
necessary, the amendment of those documents.
We are also prepared to
initiate forensic investigations of suspected mismanagement by HOA officers,
board members and managers.
